With the December 2018 release of updates to the Department of Justice (“DOJ”) White Collar Manual and in other recent communications, the DOJ has reaffirmed a focus on individual accountability in Foreign Corrupt Practices Act (“FCPA”) violations and has seemingly eased up on the “all or nothing” approaches established by the Yates Memo.
