With the December 2018 release of updates to the Department of Justice (“DOJ”) White Collar Manual and in other recent communications, the DOJ has reaffirmed a focus on individual accountability in Foreign Corrupt Practices Act (“FCPA”) violations and has seemingly eased up on the “all or nothing” approaches established by the Yates Memo. In this panel, we will explore how the DOJ White Collar Manual and other DOJ policy updates may impact the manner in which both companies and the DOJ address potential FCPA violations.
